What is a producer responsibility organization (PRO)?
A Producer Responsibility Organization (PRO)is a system that helps manufacturers, importers, and distributors operationally implement their legal obligations under Extended Producer Responsibility (EPR). The legal basis for this is provided by the Battery Act Implementation Act (BattDG)and the EU Battery Regulation (EU-BattVO).
An OfH acts as a specialized service provider that handles the complex tasks of collection, logistics, recycling, and reporting of used batteries on behalf of its members. It ensures that collection points offer a convenient and free option for returning batteries and that the waste is treated in an environmentally sound manner using state-of-the-art technology.
Why is it necessary for manufacturers to join an OfH?

1. Legal registration requirement:Before batteries may be sold in Germany, manufacturers must register with the EAR Foundation. Failure to register properly and provide proof of disposal arrangements results in an immediate ban on sales.
2. OfH Beteiligungspflicht: Unabhängig von der Batteriekategorie sind Sie verpflichtet, sich an einer Organisation für Herstellerverantwortung (OfH) zu beteiligen. Ohne bestätigte OfH-Beteiligung gilt ein sofortiges Vertriebsverbot!“
3. Nationwide take-back obligation:Manufacturers are legally required to accept used batteries free of charge throughout Germany. An OfH has the necessary logistics network to implement this cost-effectively for many manufacturers at the same time.
4. Complex documentation and reporting requirements:Manufacturers must report detailed data on quantities placed on the market and collected to the authorities. An OfH handles this data management via secure reporting portals and prepares the required reports in accordance with Article 75 of the EU Battery Regulation.
5. Safety in accordance with hazardous materials regulations:Industrial batteries (such as Li-ion or LFP) in particular are subject to strict ADR regulationsfor transport. OfH guarantees compliance with hazardous materials regulations through certified partners.
